Respondents Petition filed under Section 482 of the Criminal Procedure Code, to direct the respondents to give police protection to the petitioner and his family members and permit the petitioner to agriculturing the petitioner's land bearing Survey No.156/2, Patta No.434 measuring about 4 acres 82 cents, situated at Chitheri Village, Pallakadu, Salem District to secure the ends of justice.

O R D E R

This Criminal Original Petition has been filed for a direction to the respondents to give police protection to the petitioner and his family members and permit the petitioner to carry out agricultural work in his land bearing Survey No.156/2, Patta No.434 measuring about 4 acres 82 cents, situated at Chitheri Village, Pallakadu, Salem District, complaining that one Sithaiyan Gounder has trespassed into the land of the petitioner causing hindrance to the petitioner to carry out his agricultural work and also threatening him with dire consequences. It is also stated that the petitioner has made a representation dated 02.03.2017 to the respondent-police, in this regard.

2.Mr.C.Emalias, learned Additional Public Prosecutor, takes notice for the respondents.

3.Without expressing any opinion as to the merits of the contentions raised by the petitioner, the Criminal Original Petition is disposed of directing the petitioner to submit a copy of his representation dated 02.03.2017 along with a copy of this order to the second respondent. On receipt of the same, the second respondent shall consider the representation of the petitioner dated 02.03.2017 and pass appropriate orders on merits and in accordance with law, after affording due opportunity to the petitioner as well as any of the interested parties.
