Petition praying that in the circumstances stated therein the High Court will be pleased to direct the return of passport bearing No.N1399582 presently on the custody of the court of the Metropolitan Magistrate for trial of CCB and CBCID Cases, Egmore, Chennai to the petitioner on such terms and conditions in Crl.O.P.No.24899 of 2018 dated 02/11/2018 Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.R.SATHISH KUMAR, Advocate for the petitioner and of MR.M.MOHAMED RIYAZ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This petition has been filed seeking for return of passport which has been deposited before the Court below, pursuant to the conditions imposed by this Court in Crl.O.P.No.24899 of 2018, dated 26.10.2018.
2. The petitioner is a businessman who wants to visit various countries for business purpose. Therefore, he requires the passport for the purpose of getting visa to visit those countries.
3. Mr.A.Raghunathan, the learned senior counsel would submit that the petitioner is trying his best to settle the disputes. That apart, the petitioner has to make a visit to foreign countries for business purposes and the petitioner will return back to India within a period of three months. The learned senior counsel would further submit that the petitioner is a permanent resident in Chennai and all his relatives are in Chennai and the petitioner has already deposited a sum of Rs.25,00,000/- in the Court, pursuant to the directions given by this Court in the above said order. The learned senior counsel further submitted that the petitioner will
return back to India on or before 25.04.2019.
4. The learned Additional Public Prosecutor would submit that the petitioner should give an undertaking regarding the date on which he will return back to India after his business trip and sufficient conditions must be imposed before any permission is granted to the petitioner.
5. Taking into consideration the facts and circumstances of the case, the Court below is directed to return the passport to the petitioner subject to the condition that the petitioner undertakes to file an affidavit before the Court as to the date on which he is going to leave India and the date on which he will return back to India. The Court below shall impose necessary conditions to return the passport to the petitioner.
