... Respondent Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records in connection with impugned proceedings dated nil of the respondent in respect of application No.200081330921835 dated 23.09.2021 and quash the same and consequently direct the respondent to provide electricity connection to the petitioner's house situated at S.No.89/3 of Thandiappanur Village, Uthangarai Taluk, Krishnagiri District.
For Petitioner : Mr.K.Thiruvengadam For Respondents : Ms.Keerthana Shenoi for Mr.L.Jai Venkatessh Standing Counsel
O R D E R
Ms.Keerthana Shenoi, learned counsel on behalf of Mr.L.Jai Venkatesh, learned Standing Counsel accepts notice for the respondent and is armed with instructions to proceed with the matter finally. Hence, by consent expressed by both learned counsel, this Writ Petition is disposed finally even at the stage of admission.
2. The petitioner claims to be in ownership and possession of 1.06.0 hectares of dry lands comprised in S.No.89/3 situated at Thandiappanur Village, Uthangarai Taluk, Krishnagiri District. She states that her family have been cultivating and in enjoyment of the aforesaid property for the last nearly 100 years. Assignment Patta has been granted in favour of the petitioner's husband one A.Kasi and his siblings. The petitioner further states that consequent upon the recent demise https://hcservices.ecourts.gov.in/hcservices/
of her husband, she is residing in the property alone and hence she sought electricity connection to the property on 23.09.2021.
3. Notice had been issued to her on 05.10.2021 calling upon her to submit supporting documents, such as house tax receipts and revenue documents, within seven days. There appears to have been no response to this notice, thus, learned counsel for the petitioner would state that the petitioner had immediately thereafter approached the respondent personally and requested them to cause verification of the property and grant electricity connection. In any event and admittedly the documents as sought for have not been produced.
4. I thus find nothing untoward in the impugned order which states that the application has been put on hold in order to enable the petitioner to produce the supporting documents, which are yet to be received.
5. In the above circumstances, the petitioner is permitted to file documents in support of her application and those sought for by the respondent within a period of two (2) weeks from today. Upon receipt of the same, the respondent will consider the application of the petitioner already filed on 23.09.2021, either granting connection, if satisfied or pass a speaking order on merits and in accordance with law, if not satisfied, within a period of four (4) weeks thereafter.
6. This Writ Petition is disposed in the aforesaid terms. No costs. WMP No.2469 of 2022 is closed.
