M/S. Arun Kumar Deedwania, Engineers And Builders, v. M/S. Union Of India, Rep.By Its Cheif Engineer,

2020-09-30Honourable Mr Justice M. Sundar3 pages

A.No.555 of 2020 in O.P.No.311 of 2020 & A.No.556 of 2020 in O.P.No.121 of 2020 M.SUNDAR.J., 'O.P.No.121 of 2020' shall be referred to as 'senior OP' and 'O.P.No.311 of 2020' shall be referred to as 'junior OP' for the sake of convenience and clarity.

2.Senior and junior OPs are directed against two arbitral awards, one dated 14.03.2017 and another dated 20.05.2017 for little over Rs.40.70 lakhs and 55.86 lakhs respectively. Both arbitral awards are between the same parties and as the transactions are dovetailed, senior and junior OPs have been tagged together. Pursuant to two separate stay applications in senior and junior OPs, this Court had directed deposit of 50% of the respective award amounts (together with interest upto the date of the award). This was done and thereafter captioned applications i.e., A.No.555 of 2020 and A.No.556 of 2020 were taken out with payment out prayers.

There is no disputation or disagreement before me that from and out of the deposit, a total sum of Rs.40 lakhs has already been paid out 1/3

and the balance is now lying under a interest bearing deposit in this Court. Today in the web-hearing on a video-conferencing platform Mr.V.P.Raman, learned counsel on record for the applicant in both captioned applications and Mr.Venkataswamy Babu, learned Senior Panel Counsel, Government of India on behalf of sole respondent in both applications (Union of India) 30.09.2020 gpa 2/3
