Originally this application has been filed as Original Application No.1727 of 2004 before the Tamil Nadu Administrative Tribunal at Chennai and after abolition of TNAT, application has been transferred and re-numbered as W.P.No.17957 of 2007. Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorari, to call for the records pertaining to the order passed by the 3rd respondent in S.O.No.12/2004 in P.R.No.33/03 dated 19.01.2004 and consequent order RC.No.82/SP.08/2004 dated 07.04.2004 passed by the second respondent and set aside the punishment awarded by quashing the charge No.2 in the PR No.33/03. ORDER

This Writ Petition has been filed calling for the records of the order passed by the third respondent in S.O.No.12/2004 in P.R.No.33/03 dated 19.01.2004 and consequent order RC.No.82/SP.08/2004 dated 07.04.2004 passed by the second https://hcservices.ecourts.gov.in/hcservices/

respondent and set aside the punishment awarded by quashing the charge No.2 in the PR No.33/03.

2. It is averred in the writ petition that the petitioner has filed Original Application in O.A.No.1727 of 2004 before the Tamilnadu Administrative Tribunal, Chennai. Subsequently, due to abolition of Tribunal, the matter has been transferred before this Court and renumberd as W.P.No.17957 of 2007.

3. When the matter is taken up for hearing today, there is no representation on behalf of the petitioner.

4. The learned Special Government Pleader appearing for the respondents would submit that the order challenged in this writ petition for modification of the order of punishment imposed on the petitioner of compulsory retiremnent has already been modified and the relief sought for in this writ petition has become infructuous as nothing survives in this writ petition to be adjudicated upon further.

5. Considering the submission made by the learned Special Government Pleader, since the order challenged in this writ petition has already been modified, nothing survives for further adjudication in this Writ Petition.
