A.D.JAGADISH CHANDIRA, J., The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 of IPC in Crime No.256 of 2018, seeks anticipatory bail.

2. Today when the matter came up for hearing, there is no representation for the petitioner.

3. The case of the prosecution as per the defacto complainant is that under the guise of making the defacto complainant's wife as a partner in the business, A1 and A2/petitioner herein received a sum of Rs.29,50,000/- and Rs.18,50,000/- from the defacto complainant. However, she was not made as a partner and the petitioner has not returned the money. Hence the complaint.

4. Learned Government Advocate (Criminal Side) appearing for the respondent would submit that the petitioner had earlier approached this Court seeking anticipatory bail in Crl.O.P.No.19693 of 2018. This Court vide order dated 21.08.2018 imposed condition and directed the petitioner to deposit a sum of Rs.10,00,000/- (Rupees Ten Lakhs only) to the credit of Crime No.256 of 2018. Subsequently, the petitioner had filed

Crl.M.P.No.7084 of 2021 seeking for modification. This Court vide order dated 26.07.2021 had dismissed the same. Now the present petition has been filed suppressing the earlier order.

5. This Court had earlier granted bail to the petitioner by imposing certain condition and subsequently dismissed the miscellaneous petition filed by the petitioner seeking to modify the condition and further this is the second bail petition filed by the petitioner.

6. In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original petition is dismissed.
