The Miscellaneous Petition has been instituted to suspend the conviction and sentence of the petitioner/appellant in Special S.C.No.241 of 2019 dated 27.09.2022.

We have carefully gone through the evidence of PW2/victim, minor girl aged about 6 years at the time of occurrence. The petitioner has not made out any prima facie case for granting suspension of sentence.

Consequently, the Criminal Miscellaneous Petition is dismissed. List Crl.A.No.17 of 2023 after two weeks.
