O R D E R
(Order of the Court was made by P.N.PRAKASH,J.) This Habeas Corpus Petition is filed by the father of the detenu for a direction to the respondent to produce the detenu before this Court and set him at liberty.
2. It is seen that the petitioner's son went missing and in connection with which a case in crime No.520 of 2015 has been registered on 09.09.2015 for man missing and the investigation is in progress. In the complaint, the petitioner has stated that the detenu has taken nine sovereigns of jewellery and went away from home.
3. It is seen that initially the petitioner's son was secured and once again he had gone out of the petitioner's house. It is also conceded by the petitioner that the detenu is https://hcservices.ecourts.gov.in/hcservices/
enamored about a woman. Hence, it is unlikely that he will come back to the petitioner's house.
4. In such circumstances, we feel that there is no illegal detention and hence, Writ of habeas corpus cannot be issued. However, the respondent-police is directed to proceed with the investigation in Crime No.520 of 2015 and keep the petitioner informed about the further developments in this case.
