C.M.P.Nos.1103 of 2016 & CMP.No.1 of 2015 in C.M.A.No.2147 of 2015 D.HARIPARANTHAMAN, J., This miscellaneous petition is filed by the Claimant seeking permission of this Court to withdraw the amount deposited by the appellant to the credit of MCOP No.6290 of 2013 on the file of the Motor Accidents Claims Tribunal, II Judge, Small Causes, Chennai.

2.This court, while admitting the appeal, directed the appellant/Insurance Company to deposit entire Award amount, pursuant to which, the amount was deposited.

3. Heard both sides.

4. Considering the submissions of both sides, both these M.Ps are disposed of with the following direction :

(i) the order of interim stay is made absolute.

(ii) the claimant is permitted to withdraw 50% of the award amount deposited together with proportionate interest. The claimant is permitted to withdraw the accrued interest once in six months till the disposal of this appeal.
