This Original Petition has been filed under Section 372 of the Indian Succession Act XXXIX, 1925 read with Order XXV Rule 6 of the Madras High Court Original Side Rules, to grant succession certificate to the petitioner with power to collect the debt and to receive interest, as specified in the schedule.
2.It is the case of the petitioner that his mother Mrs.Kanthamani Rengan died on 24.09.2015. She has left the deposits in State Bank of India, R.A.Puram Branch, Chennai. The brother of the petitioner died on 25.06.2018 and the petitioner is the only Class I legal heir of the deceased Kanthamani Rengan. Hence, the petitioner seeks succession certificate. 3.The petitioner has examined himself as P.W.1 and marked 7 documents as Exs-P.1 to P.7. None has objected for grant of succession certificate in favour of the petitioner. The petitioner himself has deposed 1/3
about the deposits made by his mother. The document viz., Ex-P.1 is the photocopy of the Aadhaar card of the deceased Kanthamani Rengan; Ex-P.2 is the computed generated death certificate of the deceased; Ex-P.3 is the computer generated death certificate of the petitioner's father; Ex-P.4 is the legal heirship certificate of the deceased Kanthamani Rengan; Ex-P.5 is the photocopy of the petitioner's Aadhaar Card; Ex-P.6 is filed to show the nature of the deposits made by the deceased; Ex-P.7 is the paper publication. 4.Considering the averments made in the petition and the documents filed by the petitioner and as no other claim is made, this Court is of the view that the petitioner is entitled to succession certificate. 5.Accordingly, this Original Petition is ordered as prayed for and a direction for grant of Succession Certificate in favour of the petitioner with power to collect the debt and to receive interest, as specified in the schedule, is issued.
