(Order of the Court was made by M.M.SUNDRESH, J.) Seeking to condone the delay of 302 days in filing the appeal, the present petition has been filed.
2.Learned counsel appearing for the petitioner submitted that due to administrative reason, the delay has occasioned. Learned counsel appearing for respondents 1 to 5 submitted that the said ground taken cannot be a factor to condone the delay. 3.We find that the petitioner is entitled to contest the matter on merits. In such view of the matter, we deem it appropriate to condone the delay by putting the petitioner on terms. Though counter affidavit has been filed, considering the facts and circumstances of the case, we are inclined to condone the delay on condition that the petitioner pays a sum of Rs.5,000/- (Rupees Five Thousand only) to the learned counsel appearing for respondents 1 to 5 within a period of two weeks from today.
