Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Declaration to declare that the Rule 5(b) of the General and Special Rules applicable to the holders of the permanent posts in Tamil Nadu Higher Secondary Educational Service apply to the holders of temporary posts of Senior Lecturers and Lecturers in the Directorate of Teacher Education Research and Training and District Institute of Education and Training in the State as published in

Notification No.III under G.O.Ms.No.133 School Education Department, dated 14.06.2007 to the limited extent of non Senior Lecturer in Physical Education unconstitutional and ultra vires and quash the order passed by the 2nd respondent made in Pro.Na.Ka.No.0066/A2/2010 dated 10.9.2011 to the limited extent of remarks against the petitioner's name at Sl.No.15 therein in the last column as vk;.vl; ,y;iy and to issue and to issue consequential direction to the respondents to include the name of the petitioner in the appropriate place in the panel for the year 2012 for promotion as Senior Lecturer (Physical Education) and to promote him as such with retrospective effect from the date of promotion of his immediate junior with all consequential benefits.
