Common Prayer : Writ Petitions filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents herein to consider, dispose of and pass orders on merits on the representation of the petitioner dated 19.09.2022 to include his name in the list of contract labourers and to absorb him as permanent employee in the Respondents Board.
For Petitioner (in all WPs) : Mr.A.Saravanan For Respondents (in all WPs) : Mr.Anand Gopalan for M/s.Agam Legal ***** COMMON ORDER Since the issue involved in these writ petitions are one and the same, with the consent of the learned counsel appearing for the parties, these writ petitions were heard together and disposed of by way of this common order.
2. The case of the respective petitioner is that, they were engaged as contract labourers in the office of the 3rd respondent and they were allotted to erect Electric post and putting Low Tension and High Tension electric lines between the post and also during Vartha cyclone and Gaja cyclone for Tamil Nadu Electricity Board. While so, to identify them as Page No.2 of 6
contract labourers and to get compensation and also to appoint them permanently in the 3rd respondent, they have submitted necessary application along with necessary documents to the respondents. Though the application to consider the same was submitted, their names were not in the included in the identification list, which were prepared by the 2nd respondent periodically. Therefore, they have submitted representations dated 19.09.2022 and 15.09.2022 respectively to the 2nd respondent, however, till date, the same has not been considered. Hence, the above writ petitions have been filed before this Court.
3. Though very many grounds have been raised in these writ petitions, learned counsel appearing for the respective petitioner submits that, it would suffice, if this Court, issues a direction to the respondents to consider the representations dated 19.09.2022 and 15.09.2022 of the respective petitioner and pass appropriate orders, within a time frame that may be stipulated by this Court.
4. Learned counsel appearing for the respondents submits that, the representations of the respective petitioner will be considered and appropriate orders will be passed, as expeditiously as possible. Page No.3 of 6
5. Considering the limited relief sought for by the learned counsel appearing for the respective petitioner, this Court, without going into the merits of the case, directs the respondents to consider the representations dated 19.09.2022 and 15.09.2022 of the respective petitioner and pass appropriate orders, on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
6. With the above directions, the Writ Petitions are disposed of. No costs.
