O R D E R
(This case has been heard through video conference) The petitioner was convicted and sentenced to undergo rigorous imprisonment for a period of 10 years and to pay fine of Rs.1000/- in default to undergo Simple Imprisonment for 3 months by the Judgment dated 24.02.2016 in S.C.No.82 of 2011 by the learned VI Additional Sessions Judge, Chennai, for the offence under Section 304(1) of IPC.
2. The learned Counsel for the petitioner would submit that the petitioner was convicted by the Judgment dated 24.02.2016 passed by the learned VI Additional Sessions Judge, Chennai, and that he is in prison for more than five years. He would submit that the petitioner's father Ramanathan, aged 69 years is suffering from heart ailments and being the son, the petitioner has to visit his father and thereby, the petition has been filed seeking for interim bail for a short duration. He would submit that on earlier occasion also, the petitioner had been granted interim bail by order dated 20.09.2018 vide Crl.M.P.No.12564 of 2018 and in due compliance of the interim bail, the petitioner
had surrendered before the prison authorities on 24.09.2018. He would further submit that the conduct and character of the petitioner in jail is also without any blemish and thereby, he would seek for interim bail.
3. The learned Government Advocate (Crl. Side) would submit that the petitioner has been convicted by the Judgment dated 24.02.2016 and sentenced to undergo rigorous imprisonment for a period of 10 years. She would submit that the report of the Probation Officer also stats that the father of the petitioner is suffering from heart ailment.
4. Taking into consideration of the fact that the petitioner's father is suffering from heart ailments, the petitioner is granted INTERIM BAIL for a period of nine days from 22.03.2021 to 30.03.2021.
5. Accordingly, the petitioner is ordered to be released on interim bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with one surety to the satisfaction of the learned XXIII Metropolitan Magistrate, Saidapet, Chennai, and on further conditions that;
a. The petitioner shall report before his jurisdictional police station namely, Inspector of Police, Ponnamaravathi Police Station, Pudukkottai District on 24.03.2021, 26.03.2021 and 28.03.2021 at 5.30 p.m.
b. The petitioner shall be accompanied by an Escort and the expenses for the Escort shall be borne by the Government. c. The petitioner shall surrender before the Superintendent, Central Prison, Puzhal, Chennai, on 30.03.2021 at 5.30 p.m.
