Respondent PRAYER: Criminal Miscellaneous Petition filed under Section 389 r/w. 439 of Cr.P.C. and Section 430(1) of BNSS, to suspend the sentence imposed in Spl.S.C.No.207 of 2019 by judgment dated 18.07.2023 by the Special Court for Trial of Cases under POCSO Act, Tiruvannamalai in Criminal Appeal No.103 of 2023 and enlarge the petitioner on bail.

ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner, seeking to suspend the sentence imposed in Spl.S.C.No.207 of 2019 by a judgment dated 18.07.2023 on the file of the Special Court for Trial of Cases under POCSO Act, Tiruvannamalai and enlarge the petitioner on bail.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. This is the second petition filed by the petitioner to suspend the sentence imposed by the trial Court. As there is no change of circumstances in the case, this Court is not inclined to suspend the sentence imposed on him. 4.
