records of the second respondent vide letter dated 25.10.2011 under Ref.No.33374/U-Spl/2011-1 and quash the same as illegal and invalid and consequently direct the respondents (R1 to R3) to consider the petition for recognizing the seniority of the Petitioner of 'Batch - I' and qualifying for all the subsequent promotions with accrued back wages, interest with revised pension.

For Petitioner : No Appearance For Respondents : Mr.G.Ameedius Government Advocate.

ORDER

In spite of the matter being listed under the caption for dismissal, there is no representation for the petitioner.

2.

From a perusal of the material on record, it is noticed that the petitioner made a request for revision of seniority, which was pertaining to the year 1970 by submitting representation dated 17.03.2011 and the said request of the petitioner was declined by the respondents. The petitioner appears to have made said request considering the fact that the respondents are revising the seniority of Assistant Section Officers belonging to the batch Page No.2 of 5

of 1970 to 1974, pursuant to the order passed by the Tamil Nadu Administrative Tribunal and by implementing the said order. As there was no such order passed ordering for revision of such seniority in the first batch in which the petitioner belongs, the respondents have declined the request made by the petitioner. The seniority of 1970 batch was already settled, the question of unsettling such seniority after a lapse of 40 years does not arise as the same would amount to unsettling the settled seniority after a long lapse of time.

3.

In the circumstances, this Court does not find any merit in this writ petition. Accordingly, this writ petition is dismissed. The miscellaneous applications, if any, shall stand closed.
