This Original Petition has been filed seeking grant of Letters of Administration under Sections 232 & 276 of the Indian Succession Act, 1925 with Will annexed, relating to the last Will and testament dated 29.10.2015 executed by Mrs.Shanthi Subramaniam who died on 12.01.2020.

2. The petitioner is her nephew and beneficiary under the Will. The respondent is her husband. It is stated that the deceased and the respondent did not have any children.

3. After following due procedure the petitioner was invited to adduce evidence. He examined himself as P.W.1. The original Will deed dated 29.10.2015 was marked as Ex.P1 and the death certificate of Shanthi Subramaniam was marked as Ex.P2. The consent affidavits was marked as Ex.P5.

4. The petitioner also examined C.R.Lakshmi as P.W.2 and Mr. G.V.Subramaniam as P.W.3. They were the attesting witnesses. G.V.Subramaniam is also incidentally the respondent. They both identified the Will and also identified the signatures. They specifically stated that the testatrix was in a sound and disposing state of mind when the Will was executed.

nst 5.In view of the evidence adduced, I hold that there is every reason to grant the relief sought in the Original Petition namely, granting Letters of Administration with Will annexed.

6.With the above observations, this Original Petition stands allowed. The petitioner is directed to duly administer the properties and credits of the deceased more fully described in the schedule. The petitioner is directed to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) in favour of the Assistant Registrar (O.S.II) High Court, Madras. The petitioner is further directed to render true and correct accounts once in a year.
