This application is filed to condone the delay of 168 days in filing the written statement of 5th defendant.

2. The learned counsel for the plaintiff has no serious objection in allowing the application.

3. Having satisfied with the averments stated in the affidavit, filed in support of the application, the application is allowed and the delay is condoned.

4. The written statement filed by the 5th defendant is taken on record.

5. Post the matter on 16.02.2022 for framing of issues.
