JUDGMENT
When the matter was taken up for hearing today, it is represented by the counsel for the appellant that the appellant died and since sufficient time was granted to him to take steps, he was not able to implead the legal heirs of the deceased appellant herein.

3. Accordingly, this Civil Miscellaneous Petition is dismissed for not taking steps to implead the legal heirs of the deceased appellant. No costs.
