Application No.315 of 2022 has been filed to condone the delay of 109 days in filing the setting aside the abatement of late A.N.Dyaneswaran, who passed away on 19.04.2021.
2.Application No.316 of 2022 has been filed to set aside the abatement as against the late A.N.Dyaneswaran, who passed away on 19.04.2021. 3.Application No.317 of 2022 has been filed to bring on record the legal representatives of A.N.Dyaneswaran (died) namely Shri A.D.Senthureswaren and A.D.Sukavaneshwar as party defendants in C.S.No.605 of 2008. 4.It is seen that the notice was ordered by this Court and the same has been served on the parties and the names of the respondent R3 and R4 is printed in the cause list and filed Affidavit of Service to the same. 5.Having satisfied with the reasons stated in these affidavits filed in support of these application, these applications are allowed as prayed for. 1/2 https://www.mhc.tn.gov.in/judis

Pam 6.Learned counsel for the respondents has no serious objection in allowing these applications.
7.Considering the submission made by the learned counsel for the applicant, this Court is inclined to allow applications A.Nos.316 and 317 of 2022. Accordingly, these applications are allowed. A.No.315 of 2022 is allowed only on payment of cost of Rs.5,000/- to be paid to the Advocate Clerks Association on or before 10.03.2022 by the applicant, failing which A.No.315 of 2022 alone would be stand dismissed automatically without any further reference to this Court.
8.Learned counsel for the applicant is directed to carry out the necessary amendment in the cause title.
