ORDER
The present writ petition is filed challenging the impugned order dated 20.08.2024 passed by the respondent relating to the assessment year 2021-22.
2. It is submitted by the learned counsel for the petitioner that the petitioner is a trader in plastic materials and is registered under the Goods and Services Tax Act, 2017. During the relevant period 2021-22, the petitioner had filed its returns and paid the appropriate taxes. However, on verification of the returns filed by the petitioner in Form GSTR-1, GSTR-5 and GSTR-6 & 9, it was noticed that there was a mismatch between GSTR-3B and GSTR-2A/2B.
3. It is submitted by the learned counsel for the petitioner that, a show cause notice in Form DRC-01 dated 27.06.2022 was issued to the petitioner through common portal and thereafter personal hearing notices were also sent to the petitioner on 09.07.2024 and 20.07.2024 respectively. However, the petitioner had neither filed any reply nor availed an opportunity of personal hearing. Hence, the impugned order came to be passed by the respondent, confirming the proposals. It is also submitted by the learned counsel for the petitioner that if the petitioner is provided with an opportunity, they would be able to explain the alleged discrepancies.
