O R D E R

The present Criminal Original Petition has been filed seeking to quash the proceedings against the petitioner in S.C.No.121 of 2025 pending on the file of the Additional District Court, Hosur. 1/4

When the matter was taken up for hearing, the learned counsel for the petitioner sought permission of this Court to withdraw this petition and also made an endorsement to that effect. However, he further submitted that the petitioner/A7, who was implicated in this case only as an abettor, was not present at the scene of occurrence and that there is no direct evidence against her, therefore, her personal appearance for the purpose of identification may not be required. Hence, he sought the indulgence of this Court, to dispense with the personal appearance of the petitioner before the trial Court.

In view of the submission and endorsement made by the learned counsel appearing for the petitioner as regards withdrawal, this Criminal Original Petition is dismissed as withdrawn. Consequently, the connected miscellaneous petitions are closed. However, the personal appearance of the petitioner before the trial Court is dispensed with, except for the receipt of copies, initial questioning, framing of charges, questioning under Section 313 Cr.P.C., passing of judgment, or any other date as may be required by the trial Court. The petitioner shall be duly represented by her counsel before the trial Court.

It is made clear that the petitioner shall make herself available before the trial Court for the purpose of identification, if insisted upon by the trial Court.
