Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the record relating to the impugned order passed by the second respondent herein in his proceedings in P.R.No.128//PR/CZ/2000 dated 26/04/2010 and the order passed by the first respondent herein in Appeal No.07/PR/CZ/2011, CZO.No.312/2011 dated 28.06.2011 and quash the same and consequently direct the respondents herein to reinstate the petitioner into service with all consequential service and monetary benefits.

O R D E R

As early as on 14.06.2023, it was brought to the notice of this Court that the sole petitioner passed away. Thereafter, though the matter was adjourned from time to time on several occasions, till date no application is filed to bring the legal heirs of the deceased petitioner on record. Hence, the writ petition abated by operation of law. However, when the matter is listed today, once again request is made for grant of time for filing appropriate application. As already noted above, the matter is being adjourned from 14.06.2023, no application is filed till date. 2.

In view of the same, this Court is not inclined to grant further time by keeping the matter pending before this Court. In view of the same, the writ petition is closed as abated. However, the legal representatives of the deceased petitioner are granted liberty to file appropriate application, if they are so advised, in accordance with law.
