Sow.Subhadra Bai Saddharma Niketan Trust v. Nil

A.No.408 of 2024 in O.P.No.596 of 2022 N.SATHISH KUMAR.J., This application has been filed seeking extension of time for selling the trust property in terms of the order dated 20.12.2022 passed in O.P.No.596 of 2022.

2. The Original Petition in O.P.No.596 of 2022 was disposed of by this court by order dated 20.12.2022 permitting the petitioner to sell the property more fully described in Schedule-B to one Mr.U.Deepak Kumar for a sum not less than Rs.9.06 Crore.

3. According to the learned counsel for the applicant/petitioner, the sale could not be completed in time and therefore, he seeks further time for completing the sale process. Further, according to the learned counsel, the sale also scheduled today.

4. No respondent in this matter. Considering the averments made in the affidavit filed in support of the application and in the best interests of the trust, this court is inclined to grant further two months time to complete the sale process.

5. This application is ordered accordingly and the applicant trust is permitted to complete the sale process on or before 25.03.2024. The other conditions imposed already while granting permission to sell the property shall remain unaltered.
