It is seen from the records that the respondents 1 to 3 died long back and till date no steps have been taken by the appellant to implead the legal heirs of the deceased respondents.

2. Today also the counsel for the appellant seeks some accommodation for getting instructions from his client. The second appeal is of the year 2010 and hence, I do not find any reason to adjourn the case. Hence, this second appeal is dismissed as abated. No costs.
