Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition to deposit the original title deeds of the property worth Rs.6,00,000/- which stands in the name of the petitioner or his relatives to credit of Cr.No.31/2020 made in Crl.OP.No.17598/2020 dated 18.11.2020. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.S.JIM RAJ MILTON, Advocate for the petitioner and of MR.C.IYYAPPARAJ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This petition is filed to modify the condition imposed on the petitioner in Crl.O.P.No.17598 of 2020 dated 18.11.2020 directing the petitioner to deposit the original title deeds of the immovable property worth Rs.6,00,000/- which stands in the name of the petitioner or his relatives or friends, to the credit of Crime No.31 of 2020.
2 The learned counsel for the petitioner would submit that the petitioner had approached this Court seeking for anticipatory bail and this Court by order dated 18.11.2020 had granted anticipatory bail in Crl.O.P.No.17598 of 2020 on condition that the petitioner shall deposit the original title deeds of immovable property worth Rs.6,00,000/- stands in the name of the petitioner or his relatives or friends, to the credit of Crime No.31 of 2020. He would submit that despite the earnest steps taken by the petitioner, he is unable to secure documents worth Rs.6,00,000/- and that none of his friends and relatives are supporting him. He would submit that in lieu of the inability to comply with the condition, the petitioner is prepared to deposit Rs.1,00,000/- by way of cash to the credit of crime number to show his bonafide and would pray to modify the condition. https://hcservices.ecourts.gov.in/hcservices/
3.Heard the learned Additional Public Prosecutor appear fore the respondent.
4.Considering the above facts and submissions of the learned Counsel for the petitioner, the above said condition imposed on the petitioner in Crl.O.P.No.17598 of 2020 dated 18.11.2020 is modified to the effect that the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh Only) by way of cash to the credit of Crime No.31 of 2020 within a period of 15 days from the date on which the order copy is made ready instead of the condition to deposit original title deeds of immovable property worth Rs.6,00,000/-.
5.This petition is ordered accordingly. The other conditions shall remain unaltered.
