(Crime No.74/2025) ..Respondent(s) PRAYER: The Criminal Original Petition has been filed under Section 483 of B.N.S.S. praying to enlarge bail to the petitioner herein in C.C.No.860 of 2025 in Crime No.74 of 2025 on the file of II Additional NDPS Court. For Petitioner(s):

ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.03.2025 for the alleged offences under Sections 8(c) read with 20(b)(ii)(C), and 29(1) of NDPS Act in Cr. No.74 of 2025 on the file of the respondent police, seeks bail.

2. This case has been registered against the accused for illegal possession of 21.500 kgs of cannabis and the contraband has been recovered from the accused. Hence the case.

3. When the matter is taken up for hearing, the learned counsel appearing for the petitioner would submit that additional grounds are yet to be filed in this petition. However, while looking at the adjudication, this bail application is pending since 27.01.2026 and there was no representation for the petitioner on 20.02.2026. In such view of the position, this Court is of the view that instead of filing additional grounds, a fresh application may be filed in accordance with law.

4. Hence, this Criminal Original petition is dismissed on the ground that this case is involved with commercial quantity of contraband and not satisfied with rigors of Section 37 of NDPS Act.
