SUBRAMANIAN CMP No.4545 of 2019 IN SA.NO.302 OF 2019 1 SARADHA AMMAL [ PETITIONERS ] 2 E.MANI Vs J.SRIDHAR [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to grant an order of interim Injunction restraining the respondent or his men or agents or any one claiming under him from interfering with the peaceful possession and enjoyment of the schedule property (in CMP.NO.4545 OF 2019) pending disposal of the above SA.302 OF 2019.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.PARTHASARATHY, Senior Counsel for M/S.NANDHAKUMAR, Advocate for the petitioner and of MR.R.SUBRAMANIAN, Advocate for the respondent the court made the following order:- The suit itself one for declaration and recovery of possession of the "B" schedule property. Pending appeal, an injunction is sought for restraining the respondents from interfering with the alleged possession of the plaintiffs. The suit being one for declaration of title and recovery of possession, I do not see any reason to grant an order of injunction. Hence, the C.M.P.No. 4545 of 2019 is dismissed.
