APPEAL under Section 19 of the Family Courts Act against the order dated 15.4.2014 made in I.A.No.4508 of 2009 in O.P.No.618 of 2009 on the file of the First Additional Principal Judge, Family Court, Chennai.
For Appellant : No appearance For Respondent : Mr.R.Ganeshbabu Judgment was delivered by V.RAMASUBRAMANIAN,J This appeal arises out of an order passed by the First Additional Family Court, directing the appellant to pay interim alimony in a sum of Rs.4,000/- per month from 29.9.2009.
2. The above appeal was filed with a petition to condone the delay in representation. However, the learned counsel for the appellant did not appear. Yet, we condoned the delay in representation. Thereafter, another petition to condone the delay in filing the appeal also came up. Even then, the learned counsel for the appellant did not appear. Still, we condoned the delay. Today, the appeal is posted for admission. Even today, the learned counsel for the appellant is absent.
3. Probably, the counsel thought that the same indulgence will be shown in the appeal also. But, it is not possible for the simple reason that the appellant is a Deputy Secretary in the State Government and what is directed to be paid by way of interim alimony is only Rs.4,000/- per month. We find no merits to entertain the appeal.
