Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the first respondent herein to dispose of the Petitioner's appeal dated 15.10.2018 and taken on file as Appeal No.4151/2018-D3 sent for issuing Patta for the lands measuring 2400 square feet situate in S.F.No.397/1, Kookandapalli Village, Hosur Taluk, Krishnagiri District in accordance with law and within a stipulated period. ORDER
This Writ Petition has been filed for the issuance of Writ of Mandamus, directing the first respondent herein to dispose of the Petitioner's appeal dated 15.10.2018 and taken on file as Appeal No.4151/2018-D3 sent for issuing Patta for the lands measuring 2400 square feet situate in S.F.No.397/1, Mookandapalli Village, Hosur Taluk, Krishnagiri District in accordance with law and within a stipulated period. 2.Heard Mr.T.Vedi, the learned counsel appearing for the petitioner and Mr.A.M.Ayyadurai, learned Government Advocate https://hcservices.ecourts.gov.in/hcservices/
appearing for the respondents.
3.The petitioner filed an appeal for cancellation of patta issued in respect of the lands ad-measuring 2400 sq.ft, comprised in S.F.No.397/1, situated at Mookandapalli Village, Hosur Taluk, Krishnagiri District in favour of various persons without mentioning the persons to whom the pattas were issued. The petitioner filed an appeal without even mentioning the persons to whom the pattas were issued in respect of the subject property. Therefore, the request made by the petitioner cannot be considered in this writ petition.
4.However, the petitioner is at liberty to file a fresh appeal by mentioning the counter parties before the first respondent. If any appeal is received from the petitioner, the first respondent is directed to issue notice to the petitioner and the counter parties if any and conduct enquiry, after giving an opportunity of hearing to them, pass orders on merits and in accordance with law.
5.With the above directions, this writ petition is disposed of. There shall be no order as to costs.
