ORDER

This Writ Petition has been filed seeking issuance of a writ of mandamus directing the 2nd respondent to conduct an enquiry based on the payment of compensation and to direct the 1st respondent to pay just and reasonable compensation for the land acquired in erecting a High Tension electrical tower in the petitioner's property comprised in S.No.245/3K1 and 254/3L1 situated at Indira Gandhi Nagar, Kavanoor Village, Sriperumpudhur Taluk, Kancheepuram District.

The petitioner would submit that he is the owner of the above mentioned property having purchased the same under a Sale Deed dated 07.06.1996 registered on the file of the Guduvancheri Sub Registrar Officer. The said property was approved by the Director of Town and Country Planning Authority in D.T.C.P.No.M 887/L.P.73 and stands in Patta No.2058. The petitioner has been in peaceful and enjoyment of the said property.

The petitioner would further submit that the 1st respondent had initiated proceedings for laying the foundation and erection of High Tension Electrical Towers in Plot Nos.10-13 which included the petitioner's plot No.11, without issuing any prior notice to the petitioner or the other landowners. Therefore, the petitioner made a representation to the 1st respondent dated 02.03.2007. Since no action was taken on the said representation, the petitioner filed W.P.No.32341 of 2007 before this Court seeking compensation of a sum of Rs.15,00,000/- which came to be dismissed for non-prosecution and not on merits. Subsequently, a portion of the petitioner's land was taken by the 1st respondent. However, no compensation has been paid and no enquiry has been conducted by the competent authority. Despite repeated requests and a further representation dated 26.11.2025, the grievance of the petitioner remains unaddressed. Hence, the present writ petition.

Considering the facts and circumstances of the case, without going into the merits of the case, this Court directs the 2nd respondent to consider and pass appropriate orders on the petitioner's representation dated 26.11.2025 on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order.
