The petitioner, who was arrested and remanded to judicial custody on 30.12.2025, for the offence punishable under Sections 61, 318(4) of BNS Act in Crime No.26 of 2025, registered on the file of the respondent, seeks bail. 1/4

The allegation against the petitioner is that the petitioner herein is ranked as A1 in this case and the defacto complainant's husband was died in a road accident for which, the insurance claim was made by the defacto complainant and Rs.35 lakhs was deposited in her account, however by making false representations, this petitioner obtained password and other informations regarding bank transaction, subsequently, he also changed the mobile number using the customer ID and able to withdraw the amount of Rs.35 lakhs. Hence, the case was registered.

The learned counsel for the petitioner submitted that the petitioner's mother is also one of the co-sharer and she is entitled 50% of the amount and already a sum of Rs.8.5 lakhs has been returned by way of bank transaction and she also received Rs.5 lakhs, however she claims an higher amount of Rs.35 lakhs. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that investigation in this case is pending. Hence, he opposed to grant bail to the petitioner.

5. Considering the magnitude of the amount cheated by the defacto 2/4

complainant and manner in which he had changed the mobile number and customer ID of the defacto complainant and cheated her and the investigation in this case is pending, this Court is not inclined to grant bail to the petitioner.
