Mr.M.Palanimuthu, learned counsel on record for applicant and Mr.Bavisetty Sridhar, learned 'Deputy Official Liquidator' [hereinafter 'Deputy OL' for the sake of brevity] on behalf of the Official Liquidator attached to this Court [hereinafter 'OL' for the sake of brevity] are before me in this web hearing on a video conferencing platform.

3. Captioned application has been filed with a prayer to condone delay in filing an application to set aside 08.05.2017 proceedings of OL made in Claim No.442/207/2003/Claim Team-III.

4. To be noted, learned counsel for applicant has since filed a better affidavit, this Court notices that the claim pertains to provident fund dues which ultimately go to the benefit of employees if the applicant succeeds on merits qua its claims.

In this view of the matter, considering the submission of learned counsel for applicant that simultaneous efforts for realization of provident fund dues were being taken which has resulted in delay viewed in the light of learned Deputy OL very fairly submitting that there is no objection/opposition to COD prayer (without admitting or denying the averments in the affidavit and better affidavit filed in support of captioned application), captioned COD application stands allowed. There shall be no order as to costs.
