Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a direction in the nature of Writ of Mandamus, directing the Block Development Officer, Nallur and the Village Panchayat President/Secretary of Ko.Kothanur Village, the 2nd and 3rd respondents herein to allot a concrete house to the petitioner as requested in the representation dated 07.06.2024 and 30.09.2024 of the petitioner within a stipulated time as specified by this Court and pass such further orders. 1/4

This writ petition has been filed to direct the Block Development Officer, Nallur, and the Village Panchayat President/Secretary of Ko.Kothanur Village, the 2nd and 3rd respondents herein, to allot a concrete house to the petitioner as requested in the representation of the petitioner dated 07.06.2024 and 30.09.2024 respectively.
2. Learned counsel appearing for the petitioner would submit that the petitioner is a landless agriculture labour from scheduled caste community. The family is living in a dilapidated old house built some 30 years ago. Over the years, the poor quality construction developed cracks and has become unsafe for living. The Government of India and the Tamil Nadu Government provided funds for implementing the free housing scheme. The petitioner has a piece of land in S.F.No.43/1 in the year 2008 and is ready to start the construction. The petitioner approached the District Collector, the Block 2/4
Development officer Nallur, the Village Panchayat President Ko.kothanur in his representation on 07.06.2024 and 30.09.2024, requesting for the allotment of a concrete house and repeatedly visiting the BDO Office, Nallur, and the Village Panchayat President Ko.kothanur. But till date, no order has been issued for the allotment and construction. Hence, the present writ petition is filed.

Learned Government Advocate appearing for respondents 2 and 3 would submit that already the proposal is under consideration for allocation of funds to the petitioner to repair his house, and the copy of the letter to that effect is also submitted before this Court, which is signed by the 2nd respondent dated 29.01.2025. The copy of the same is also furnished to the learned counsel for the petitioner.
4. Heard both sides and perused the materials available on record.
5. Without going into the merits of the case, the 1st and 2nd respondents are directed to consider the representation of the petitioner dated 30.09.2024 in regard to allotting a concrete house to the petitioner and pass appropriate orders on merits, in accordance with law, within a 3/4
period of six (6) weeks from the date of receipt of a copy of this order. J.SATHYA NARAYANA PRASAD, J.
In the result, the writ petition stands disposed of with the above observations and direction. No costs.
