ORDER
The petitioner, who was arrested and remanded to judicial custody on 28.11.2025, for the alleged offence punishable under Sections 140(1), 103(1) of BNS Act @ 140(1), 103(4), 191(2), 191(3), 61(2), 238 of BNS Act, in Crime 1/4
No.493 of 2025 on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that he is a friend of A1. It is alleged that A1 had earlier sustained injuries in an attempted murder case, during the course of which it was revealed that the deceased in the present case had informed the whereabouts of the accused Accused no.1 to the persons involved in the earlier occurrence. With that motive, A1 to A4, along with other accused, are said to have joined hands and abducted the deceased from Krishnagiri District, took him to Andhra Pradesh, where they allegedly committed his murder and threw the body in a nearby forest area. Subsequently, the role of the petitioner was revealed during the investigation, and he was arrested on 28.11.2025. Hence, the complaint was lodged and the petitioner was arrested. 3.
The learned counsel appearing for the petitioner submitted that the petitioner is falsely implicated in this case based on the alleged confession of the co-accused He further submitted that he has not having any specific overt act and that he is in judicial custody since 28.11.2025. Hence, he prayed to grant bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the case of the prosecution and submitted that there are totally seven accused in this case and that the petitioner is arrayed as A5. Out of the said 7 accused, three have been apprehended, while A1 to A4 are still 2/4
absconding. He further submitted that the case involves offences of abduction and murder and that the investigation is still pending. Hence, he opposed the grant of bail to the petitioner.
5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the fact that the co-accused are still absconding and that the investigation is yet to be completed, this Court is of the view that if the petitioner is released on bail at this stage, there is a likelihood of his indulging in similar activities and it would also hamper the investigation. Therefore, this Court is not inclined to grant bail to the petitioner.
