This civil revision petition has been filed under Article 227 of the Constitution of India for direction to the District Munsif Judge, Alandur to dispose the I.A.No.147/2017 in O.S.No.153 of 2016, within a time frame as fixed by this court.

O R D E R

This petition has been filed for direction to the District Munsif Judge, Alandur to dispose the I.A.No.147/2017 in O.S.No.153 of 2016, within a time frame, as fixed by this court.

2. The petitioner herein is the 2nd defendant in the above said suit and the suit has been filed by the first respondent herein/ plaintiff for declarations and consequential injunction. During the pendency of the suit, the petitioner herein has filed a petition in I.A.No.147 of 2017 under Order VII Rule 11 of the Code of Civil Procedure to reject the plaint. According to the petitioner, he is at the age of 70 years and the petition is pending before the Trial Court without any progress and therefore, he filed this civil revision petition for speedy disposal of the above petition, within a time frame, as fixed by this court. https://hcservices.ecourts.gov.in/hcservices/

3. The petition in I.A.No.147 of 2017 to reject the plaint was filed by the petitioner on 20.01.2017. The counsel for the petitioner is not in a position to state whether counter affidavit has been filed in that petition or not. However, taking note of the fact that the petition is of the year 2017 and and also in the interest of justice, this court is inclined to pass the following order.

The Principal District Munsif, Alandur is directed to dispose the I.A.No.147 of 2017 in O.S.No.153 of 2016, as early as possible, within four months from the date of receipt of the copy of this order.

4. With the above direction, this civil revision petition is disposed of. No costs.
