W.P.No.18205 of 2012 is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, calling for the records of the fourth respondent in RC No.A1/22881/2011 dated 23.05.2012 and the connected proceedings RC No.A1/22881/2011 dated 28.05.2012 and quash both as illegal and consequently direct the fourth respondent to promote the petitioner to Sub Inspector from the year 2005 or 2006 or at the earlier on seniority on service records with attendant benefits. W.P.No.8133 of 2013 is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the 1st and 2nd respondents to grant the benefits of G.O.(2D) No.237, Home (Police
3) Department dated 01.07.2011 so as to give retrospective effect to the promotion and fixation of seniority of the petitioners in the panel year 1998 in the post of Sub Inspector of Police (Local) and to grant consequential promotion as Inspectors of Police with attendant monetary benefits. W.P.No.33344 of 2013 is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, to call for the records connected with the proceedings issued in C.No.A1(2)/ 0803/2012 D.O.No.700/2012 dated 06.06.2012 passed by the 3rd respondent and quash the same and consequently direct the respondents to upgrade the petitioner for the post of Special Sub Inspector of Police from 01.06.2008.

Mr.P.Kumaresan Additional Advocate General assisted by Mr.T.Seenivasan Special Government Pleader in all the cases COMMON ORDER (Order of the Court was made by S.S.SUNDAR,J.) When this batch of cases was listed on 08.06.2023, this Court directed the respective learned counsels appearing for the petitioners to file the respective II sets in each of the writ petitions on or before 12.06.2023
and directed the Registry to list the matters on 19.06.2023. Thereafter, the matters were again adjourned at the request of the learned counsel appearing for the petitioners. Though the matters are listed today, there is no representation for some of the petitioners. Learned Additional Advocate General, on instructions, submitted that the issues raised in this batch have been answered by the Hon'ble Full Bench of this Court vide order dated 04.02.2022 in W.A.Nos.3748 of 2019 etc. batch cases (The State of Tamil Nadu and others v. C.Srinivasan and others). Hence, this Court is inclined to dispose of the writ petitions in the light of the said order.

The petitioners in this batch of cases have either questioned the orders passed by the respective respondents rejecting their request for promotion as Special Sub Inspector of Police or upgradation to the said post after completion of 25 years of service, by taking into account their date of appointment/entry into service or for a direction to the respondents to re-fix their seniority and give them retrospective promotion to the post of Special Sub Inspector of Police irrespective of the currency of punishment or otherwise and grant them the promotion or upgradation or pensionary
benefits, as the case may be, on par with their juniors with all attendant and monetary benefits.
3. For the disposal of this batch of cases, for the sake of brevity, the facts pleaded by Mr.V.Jayachandran, the petitioner in Writ Petition No.21467 of 2007 are referred to in this common order. The petitioner has sought for issuance of writ of certiorarified mandamus, calling for the records relating to the orders in (1) C.No.A2/19891/2005 dated 14.07.2006 of the Deputy Inspector General of Police, Vellore Range, the second respondent herein and (2) Rc.No.259229/NGB.IV(1)/2006 dated 16.04.2007 of the Director General of Police, the first respondent herein, quash the same and issue consequential directions to the respondents to include the name of the petitioner in the 'C' list of the year 2003 for promotion as Sub Inspector of Police (Local) and promote him as such with retrospective effect from the date of promotion of his immediate junior with consequential benefits. According to the petitioner, he joined the service as Police Constable Grade II on 15.11.1975 and was promoted as Police Constable Grade I on 01.09.1994, which was advanced to 25.01.1993
subsequently. He was promoted as Head Constable on 30.09.1999, which was also advanced to 15.01.1998 subsequently. The petitioner was serving as Head Constable at Bagayam Police Station at the time of filing the writ petition. The grievance of the petitioner is that even though the dates of his promotion as Grade I Police Constable and Head Constable were advanced as stated supra, his name was not included in the 'C' list/panel for promotion as Sub Inspector of Police for the year 2003. The Government in G.O.Ms.No.1681, Home (Police.V) Department dated 03.06.1997 issued orders (i) for upgradation of Police Constables Grade II, who have put in 10 years of service in Grade II, as Police Constables Grade I and (ii) for upgradation of Police Constables Grade I, who have put in 5 years of service in that Grade, as Head Constables.
By the Government Letter No.107160/Police.V/97-2 dated 07.01.1998 it was further ordered that the Police Constables Grade II appointed upto 31.12.1975 should be upgraded as Police Constables Grade I. Even though the petitioner was enlisted as Police Constable Grade II on 15.11.1975, he was not upgraded as Police Constable Grade I during 1992-1993 and he was also not given promotion as Head Constable during 1997-1998.
representation, the Superintendent of Police, Vellore, in his D.O.No.719/2005 dated 27.06.2005 revised his upgradation as Police Constable Grade I and as Head Constable from 25.01.1993 and 15.01.1998 respectively and he was moved to Selection Grade in the post of Police Constable Grade I from 01.01.1997 and his pay was re-fixed accordingly. By virtue of advancement of the date of upgradation in the post of Head Constable from 15.01.1998, though he has become eligible for promotion to the post of Sub Inspector of Police in the year 2002 itself having completed four years of service as Head Constable, his claim has not been considered. Since the further representations made to the respondents in this regard have been rejected by the impugned orders, the petitioner has filed the writ petition.

A detailed counter affidavit has been filed by the respondents stating that the petitioner HC 725 V.Jayachandran of Vellore District was enlisted as Grade II Police Constable on 15.11.1975 and he was originally promoted as Grade I Police Constable with effect from 01.09.1994 and as Head Constable with effect from 30.09.1999 respectively. Subsequently,
based on his representation, his date of promotion as Grade I Police Constable and Head Constable stood advanced to 25.01.1993 and 15.01.1998 respectively. As per the petitioner's original promotion as Head Constable (30.09.1999), he completed the required four years of service as Head Constable to participate in the promotion test only on 29.09.2003. Since the crucial date for consideration of names for drawal of 'C' list of Head Constables (Local) fit for promotion as Sub Inspector of Police (Local) is the first of July of every year, he was not called for to attend the promotion tests held in Vellore Range in the year 2003. However, his name was considered for the panel year 2004 and 2005 and he accordingly appeared for range promotion tests (written tests) for the year 2004 conducted in January 2005.
But he failed to qualify himself in the written test. Even though he appeared for the tests conducted in January 2006 for the panel year 2005, he again failed to qualify. Therefore, his claim that had he participated in the earlier years 2002 and 2003, he would have succeeded is only hypothetical, as he was not qualified to participate in the tests for the years 2002 and 2003.
sympathetic consideration to ensure uniformity in the time bound promotions throughout the State and the same is notional in nature. This did not make him automatically eligible for promotion as Sub Inspector of Police without appearing in the tests. The panel of Head Constables fit for promotion as Sub Inspectors were drawn as per Special Rules for Tamil Nadu Police Subordinate Service and the candidates who satisfied the conditions laid down in the above rules were subjected to written test, drill test and viva-voce test and marks were also awarded for service records such as ACR ratings, rewards earned and punishments imposed and as such, the advancement of the petitioner's seniority much later in the year 2005, that too notional in nature, did not automatically make him eligible for inclusion in the panel or for promotion.

The sum and substance of the grievance projected by the petitioners in this batch of cases appears to be that though the petitioners were either promoted or sought to be promoted in the post of Special Sub Inspector of Police on completion of 10 years of service in the post of Head Constable, they are entitled to the time bound promotion and that their candidature
ought to have been considered for promotion not after completion of ten years in the post of Head Constable, but with reference to the number of service rendered by them in the lower posts, namely, Police Constables Grade II and Grade I respectively.

Having heard the respective learned counsels appearing for the petitioners and the learned Additional Advocate General appearing for the respondents, this Court is of the view that the issues raised in the present batch of cases are no longer res integra, as the same have been answered by the Hon'ble Full Bench of this Court vide order dated 04.02.2022 in W.A.Nos.3748 of 2019 etc. batch cases (The State of Tamil Nadu and others v. C.Srinivasan and others (supra). When an apparent conflict between the judgments of co-equal Division Benches in The Principal Secretary to Government v. V.Ramachandran and others in Review Application Nos.70 to 79 of 2015 and batch cases dated 22.03.2017 and in the Government of Tamil Nadu represented by Home Secretary v. V.Samy and others in W.A.(MD) No.1506 of 2011 etc., batch cases dated 17.06.2013 was found, the same was referred to a Larger Bench for an
authoritative pronouncement. On such reference, after lengthy discussions, the Hon'ble Full Bench of this Court answered the reference in the following lines:- "42. We hold that the Division Bench in V.Samy case did not lay down the law correctly and we uphold the law laid down in V.Ramachandran case to the extent that there is no deemed upgradation or deemed promotion contemplated in the relevant Government orders and the benefit of upgradation/promotion to the next level can be granted/claimed only on completion of the qualifying service in each level/rank as prescribed in the relevant Government Orders. At the risk of repetition, insofar as understanding the expression "retrospective operation" is concerned, we hold that The Government Orders operate prospectively but it imposes/grants new results in respect of a past event. In other words, the Government Order
operates forward but it looks backward and in that it attaches new consequences for the future to an event that took place before the Government Order was issued. If the Government Orders are understood in this perspective, there is no need to get into the issue of "retrospective operation". Thus, we are of the view that the Division Bench while rendering the judgment in V.Ramachandran case has dealt with the Government Orders in its proper perspective and the judgment in V.Samy case is hereby overruled."
7. In the light of the above authoritative pronouncement by the Hon'ble Full Bench, the prayers made by the petitioners cannot be granted by this Court. Accordingly, all the writ petitions are dismissed with an observation that the petitioners would be entitled to be considered for promotion to the post of Special Sub Inspector of Police upon completion of 25 years of overall service with 10 years of service in the post of Head
Constable and/or subject to clearing the mandatory written, physical and viva voce tests during the relevant period including those petitioners who have expressed their grievance by way of representation before the authorities. Consequently, M.P.Nos.1, 2 of 2011 & 1 of 2012 are also dismissed. No order as to costs.
