Petition under Section 482 of the Criminal Procedure Code praying to direct the police respondent to consider the first petitioner's complaint dated 29.8.2023 and issue the non-traceable certificate to the petitioners. For Petitioners :

ORDER

This petition has been filed by the petitioners seeking to direct to the respondent police to consider the complaint given by the first petitioner 1/4

dated 29.8.2023 wherein she sought for a non-traceable certificate.

2. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondents.

3. The first petitioner had given a complaint before the respondents on 29.8.2023 seeking a non-traceable certificate on the ground that the original parent documents were lost and that unless the non-traceable certificate is obtained from the police, the petitioners will not be able to proceed further to deal with the property.

4. The learned Additional Public Prosecutor submitted that though the on-line complaint was given by the first petitioner, she is not cooperating for the enquiry and that she is not submitting the necessary documents. In view of the same, the respondent police is not able to act upon the complaint given by the first petitioner. 2/4

5. Taking into consideration the facts and circumstances of the case, there shall be a direction to the petitioners to appear before the respondent police and co-operate for the enquiry by submitting all the necessary documents. The respondent police shall conduct enquiry in line with the circular issued by the Director General of Police of Tamil Nadu dated 01.04.2022 and shall take a final decision within a period of six (6) weeks from the date of receipt of copy of this order. This Criminal Original Petition is disposed of with the above direction.
