ORDER
The writ petition has been filed in the nature of mandamus seeking a direction against the fourth respondent to promote the petitioner on the basis of the integrated seniority list of the last grade servants of Town Panchayats in Cuddalore District in accordance with the reservation as provided in G.O.Ms.No.150, Municipal Administration and Water Supply Department dated 19.08.1998.
2. The petitioner placed reliance on the proceedings of the third respondent dated 21.12.2024 in No.16223/2024/A3.
3. The learned counsel for the petitioner pointed out that the petitioner had joined as Office Assistant by transfer of service by order dated 11.04.1994. He was then posted as Office Assistant in Srimushnam Town Panchayat. He had been discharging his duty till this date. In the integrated seniority list, his
seniority is placed at No.1.
4. This information is also concurred by the respondents. It is directed that the petitioner should therefore be considered for promotion, if he is otherwise eligible in accordance with the stipulations given in G.O.Ms.No.150, Municipal Administration and Water Supply Department dated 19.08.1998. The respondents have also forwarded their instructions. Consequent to the recommendation of the name of the petitioner, the Government has forwarded the name of the petitioner to the Tamil Nadu Public Service Commissioner for appropriate concurrence and once that concurrence is received, necessary orders would be passed.
5. Taking all factors into consideration, a mandamus is issued to the fourth respondent to pass appropriate orders within a period of ten working days from date on which concurrence from the Tamil Nadu Public Service Commission is forwarded to the Government, consequent to the fact that the Government had sought such concurrence from the Tamil Nadu Public Service Commission.
