O R D E R

These Civil Revision Petitions have been filed seeking a direction to dispose the suits in O.S. 340 of 2016, 338 of 2016 and O.S. 23 of 2019 (renumbered as O.S. 339 of 2016), pending on the file of District Munsif cum Judicial Magistrate, Udumalpet.

2. According to the petitioner, he has filed suits to set aside the sale deed said to have executed by the defendants therein. The suits were filed in the year 2016. Pending suit, the respondents filed an application under Order 7 Rule 11 of C.P.C. to reject the plaint in I.A. 490 of 2017, and that application has been periodically adjourned without any reason whatsoever, and that the application is pending for more than 3 years. Hence, the present Civil Revision Petitions have been filed. 3/6

Mr.V.Srinivasan, learned counsel appearing for petitioner submitted that, now, pending suit, the respondent filed an application to reject the plaint under Order 7 Rule 11 of C.P.C., in that application, arguments was completed, but so far, no order was passed, in view of the same, the suit is also pending.

4. I have considered the submissions made by learned counsel appearing for petitioner and perused the records carefully.

5. Considering the limited prayer sought by the petitioner, without going into the merits of the case, the learned District Munsif, Udumalpet is directed to dispose the I.A. 490 of 2017 in O.S. 340 of 2016, filed by the respondent to reject the plaint on merits in accordance with law within a period of four weeks from the date of receipt of the copy of this order.
