The petitioner who was arrested and remanded to judicial custody on 04.01.2022 for the offences punishable under 8(c), 20(b)(ii)(C) and 29(1) of NDPS Act, 1985 in Crime No.9 of 2022, on the file of the respondent police, seek bail.

2. The case of the prosecution is that the petitioner along with other accused was found in illegal possession of 96 kgs of Ganja. Hence, the complaint.

3. Learned counsel appearing for the petitioner submitted that this is the third bail application of this petitioner before this Court and this Court had earlier dismissed the bail applications filed by the petitioner in Crl.O.P.Nos.27983 & 32260 of 2022. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. 4. Learned Government Advocate (Crl.Side) appearing for the respondent submitted that the accused were in illegal possession of 96 kilograms of Ganja and the respondent has seized the same. He also stated that this is the third bail application of this petitioner and on an earlier occasion, this Court has dismissed the petitioner's bail applications. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and the submissions made by both counsel and also taking note of the fact that the seized contraband in this case is commercial quantity and there is no change in circumstances of the case, this Court is not inclined to grant bail to the petitioner.
