It is seen from the records that the learned counsel for the appellant filed a memo dated 08.11.2021 seeking permission of this Court to withdraw his appearance in the above Second Appeal as the appellant has taken back the papers to engage another Advocate.

2. Today when the matter is taken up for hearing, there is no 1/3

representation on behalf of the appellant. Since the second appeal is of the year 2010, I do not find any reason to keep the appeal pending. In view of the same, the Second Appeal is dismissed for non prosecution. No costs.
