O R D E R

The prayer in this writ petition is to quash the impugned proceedings dated 06.12.2004 passed by the respondent Board, rejecting the appeal made by the petitioner against the punishment of compulsory retirement, and to reinstate the petitioner in service.

2.Today, when this writ petition was taken up, the learned counsel for the petitioner has fairly submitted that the petitioner has crossed the age of 58 years and due to the passage of time, the matter in the writ petition has become infructuous.

3.In view of the above submission made by the learned counsel for the petitioner, the writ petition is dismissed as one having become infructuous. No costs.
