The issues in these application still circulate around this Court though Original Side Appeals have been filed in O.S.A.Nos. 4 & 6 of 2023. The limited issue involved is about the naming of three Returning Officers each for the two elections ordered to be conducted by the Judge Commissioner. The Judge Commissioner had called for a meeting and had noted that some of the named Returning Officers would like to contest the elections. That would put them in a position where they would have to compromise themselves over that situation as they can never be candidates and also be Returning Officer and also be part of the electorate. To that particular extent of naming the Returning Officers, I would give liberty to the Judge Commissioner to nominate any number of Returning Officers as the Judge Commissioner is of the opinion is required for conducting the elections. The Judge Commissioner is also at liberty to retain any of the named Returning Officers, who are not contesting the election and express willingness to be Returning Officers. The Judge Commissioner in his wisdom can nominate any responsible retired Judicial Officer or legal professional or any other individual, on whom the Judge Commissioner has trust and who according to the Judge Commissioner would do an efficient work as a Returning Officer.
