ORDER
This writ petition has been filed to direct the respondents 1 to 3 to cancel the patta for the properties morefully described in the prayer to this writ petition which is now standing in the name of the respondents 4 and 5 based on the petitioners' representations dated 10.11.2025 and 21.11.2025 within a time frame to be fixed by this Court.
2. The petitioners claim that erroneously and illegally, patta was issued for the property morefully described in the prayer to this writ petition in favour of the respondents 4 and 5. The petitioners seek for cancellation of the same. The petitioners had given representations on 10.11.2025 and 21.11.2025 to the respondents 1 to 3, seeking to cancel the patta standing in the name of the respondents 4 and 5. Since the said representations have not been considered till date, this writ petition has been filed.
3. Mr. C. Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents 1 to 3. Since no adverse orders are passed against the respondents 4 and 5, notice to the respondents 4 and 5 is dispensed with by this Court.
4. No prejudice would be caused to the respondents if the petitioners' representations, as referred to supra, seeking for cancellation of patta standing
in the name of the respondents 4 and 5 for the property morefully described in the prayer to this writ petition, are considered on merits and in accordance with law after hearing the objections of the respondents 4 and 5 as well as any other third party whom the second respondent deems it fit to enquire within a time frame to be fixed by this Court.
5. This Court is not expressing any opinion on the merits of the petitioner's representations.
6. For the foregoing reasons, this Court directs the second respondent to pass final orders on merits and in accordance with law on the petitioners' representations dated 10.11.2025 and 21.11.2025, seeking for cancellation of patta standing in the name of the respondents 4 and 5 for the property morefully described in the prayer to this writ petition within a period of twelve weeks from the date of receipt of a copy of this order after hearing the objections of the respondents 4 and 5 as well as any other third party whom the second respondent deems it fit to enquire.
7. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is ordered, subject to payment of separate Court fee.
