ORDER

This Contempt Petition has been filed to punish the respondents herein for willfully and deliberately violating the order in W.P. No. 32526 of 2016, dated 08.06.2023.

2. Though this Court directed the respondents to pay the balance amount of Rs.1,45,394.88, after regarding the payment of Rs.1,29,623/-, the learned Standing Counsel for the second respondent would submit that the calculation of EL would have to be based on Leave Encashment Rules, and not based on Gratuity Rules, which was relied on by the learned counsel for the petitioner.

3. The learned Standing Counsel for the second respondent has also given a calculation showing that the actual amount due, which has already been settled.

4. The learned counsel for the petitioner would fairly submit that the entire amount has been settled.
