PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to consider the petitioner's representation dated 20.11.2024 consequently direct the respondents to remove encroachment the Vinayagar Koil constructed in the pattai land in S.No.26 in Emaper Village, Kallakurichi District.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard.

2. An allegation that a temple has been constructed on the pathway is required to be duly verified upon survey and appropriate decision has to be taken, if the allegation is found correct. A representation was made on 20.11.2024 by the petitioner. We direct the District Collector of Kallakurichi District to cause an enquiry and survey made through the Tahsildar concerned. The same shall be brought to its logical conclusion one way or the other, after affording an opportunity of hearing to person, who is alleged to have put up the

construction, within an outer limit of three months from the date of receipt of a copy of this order.
