Prayer:

Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the Arbitrator cum District Collector, Thiruvallur District, the respondent herein, to consider and dispose of the Petitioner's application dated 24.07.2016 submitted as per section 3-G (5) of the National Highways Act, 1956, after affording the petitioner an opportunity to be heard in person, within a time limit that may be stipulated by this Court.

O R D E R

This Writ Petition is filed for a Mandamus directing the Arbitrator cum District Collector, Thiruvallur District, the respondent herein, to consider and dispose of the Petitioner's application dated 24.07.2016 submitted as per section 3-G (5) of the National Highways Act, 1956, after affording the petitioner an opportunity to be heard in person, within a time limit to be stipulated by this Court.

2. The grievance of the petitioner before this Court is that the above application seeking for enhancement of compensation under the National Highways Act, 1956 has not been considered so far.

3. Needless to state that if any such application is filed by the petitioner and the same is pending before the respondent, it shall be considered on merits and orders shall be passed in accordance with law without loss of further time.

4. Accordingly, this writ petition is disposed of by directing the respondent to consider the application filed by the petitioner, if any, is pending and pass orders on the same on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
