Today when the matter is taken up for hearing, Ms.R.Anila, learned counsel representing on behalf of the appellant submitted that the appellant died on 15.10.2011 and the matter is also settled out of Court by the legal heirs of the deceased sole appellant. Therefore, the learned counsel appearing for the appellant seeks permission of this Court to withdraw this second appeal. A Memo is also filed to that effect. 2.Recording the above said submission and the memo, this second appeal is dismissed as withdrawn. No costs.
