This writ petition has been filed for the issue of writ of mandamus directing the 2nd respondent to consider the representation made by the petitioner on 11.11.2024 wherein the petitioner is seeking for grant of patta with respect to the subject property.

Heard Ms.Rabi Anandh R, learned counsel for the petitioner and Mrs.K.Indumathi Venkatesh, learned counsel for 1st respondent and Mr.A.Selvendran, learned Special Government Pleader for 2nd respondent. 3.
The case of the petitioner is that subject property was assigned in favour of the petitioner through the proceedings of the 1st respondent dated 21.02.1997. The petitioner claims that he is running a small unit in that property and the electricity connection was granted in his favour after obtaining no objection from the 1st respondent. That apart, water and drainage connection also stands in the name of the petitioner and he has also constructed a house after obtaining loan from the bank by getting No objection certificate from the 1st respondent.

The petitioner realized that without obtaining patta, it will not be possible for him to develop the property and therefore, the petitioner made an application initially before the Tahsildar seeking for patta. The same was refused to be entertained on the ground that the property has been categorized as Meikkal Poramboke and therefore, the power is only vested on the 2nd respondent by virtue of GO Ms.No.318 dated 30.08.2019. Hence, the petitioner made a fresh representation before the 2nd respondent dated 11.11.2024 seeking for patta. Since the same has not been acted upon, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the limited relief sought for in this writ petition, there shall be a direction to the 2nd respondent to deal with the representation made by the petitioner on 11.11.2024 on its own merits and in accordance with law and take a decision and pass orders within a period of eight weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above directions. No costs.
